To avoid copyright infringement problems keep the following factors in mind.


1. When posting an article on your blog quote the first paragraph, first few sentences, or a quote from the article with a link to the remaining article. Do not post the full article on your blog unless you have obtained written permission from the source.


2. Do not republish images on your blog that are copywritten unless you have written permission from the author or unless the website states that they are free to use.


3. If someone forwards you something in email and you don't know the original author, Google is your friend. Use it and see if you can find the original author to obtain permission to use it on your blog.


4. Remember that citing the source is not a substitute for obtaining permission from the copyright holder.


5. Never assume that it is just ok to use a photo from another person's blog just because you are a reader of their blog. If someone you know takes a photo that you wish to publish on your blog ask their permission to use it.

6. Acknowledge your sources.


7. When visiting blogs, before you copy something keep in mind that the person who posted the material may not own copyright to it and may not of obtained permission to use it themselves. That goes for forum boards too.


8. On many sites there are "terms of use" listed on the site for visitors to read. This is where it states if the material on the site can be used or if permission is needed. Be sure to read that section.

9. Some people infringe on copyright knowingly, assuming they won’t get caught. Don't assume you won't get caught.

10. Don't think that if you give credit, you don't need permission. This is a myth.

11. Never post it and obtain permission later. Written permission should be obtained prior to posting the work on your blog.



If you wish to check to see if someone is copying your content from your blog you can use Copyscape.

If your work has been copied send an e-mail to the blogger pointing out that their actions are an infringement of your copyright.

Excellent tips there Rose, but you also can do the following!

If you have already contacted the guilty party and you either get no response or they simply refuse to remove the content, do a whois on their domain!

This well help you identify who their hosted with.

How does someone identify the web host using the whois information?
Simple, look for the name servers, most times their listed using the ns# then the hosting name!

Example
ns1.godaddy.com
ns2.godaddy.com

Now in some cases they may be listed using the IP / DNS Address!

Example
208.109.132.201

If there listed in this matter do a whois on the IP address to obtain the Web Host! Or copy the IP / DNS address and past it into your address bar in your browser, you will see that the DNS address 208.109.132.201 takes you to Godaddy.com

The reason web host use NS#.domain.com is it looks much prettier and its easier to remember then the DNS Address!

So you now know their hosted with Godaddy.com what's the next step?

Once you have the web host information, you should then review their terms of service as well. In most cases the web host also has terms of service for client's rights and an Acceptable Use Policy or Permissions guidelines in place that each hosting client must follow.

Which you will find that most web host don't tolerate copyright infringement and they will contact the offending party to help resolve the issue.

In severe cases they will either suspended the offending website or remove it, depending on the content or if its a legal complaint filed on your behalf!

There may be some information you will need to provide to the web host to have the issue resolved in a timely matter, and also insure you provide them with as much information as possible.

How do you contact the web host?

Look for a contact form or an abuse department contact number or email.

In almost all cases the web host has an abuse@thedomain.com email address setup that's monitored frequently.

Insure your complaint is clear and precise, and it includes all the information needed so they can internally investigate and take care of the issue promptly!

Quite a thorough guide, though it can be summed up in a few words: don't copy stuff or ideas - if you take ideas, cite them. It's common sense.

Citing for ideas only - basic concepts - shouldn't really matter. As long as you don't copy verbatim. At least that's what I've heard multiple times. Permission for images and text is generally required to obtain, so you're right in that regard.

actually i've been a victim once of copyright infringement and i found a duplicate when i search my blog in icerocket directory and what did i do? since the site got no contact form or email to notify my problem, i did a drastic move and google bomb that is. so beware of those who steal your articles and didn't give a goddamn credit to the source of that article.

Copying images is delicate because so many people do it and they get floated around everywhere, and it's hard to tell if its "public domain" or copyright by someone.

Okay I have a question regarding copyrights.

I am a member of another forum which covers a wide variety of eclectic topics. One area of their site is devoted entirely to collecting all manner of articles related to the various topics of the forum. They feature the entire article with a copyright link to the original story.

How is that different?

That is NOT different at all. They are in fact infringing on copyright unless

1. They have written permission to use the article.
2. It is a reprint article and they have attached the authors bio.


Citing the source is not the same as obtaining permission.

An agreement via email would suffice. The thing with newspapers is that most news outlets that I know of sell reprints to the article.
